3 Million Injuries, One in Five Claims

The Three Types of Personal Injury Claim

Public liability claims: Accidents in public spaces — slips and trips on wet floors, defective pavement, falling objects in retail premises, and injuries on council land. These claims are brought under the Occupiers' Liability Act 1957 (for lawful visitors) or the Occupiers' Liability Act 1984 (for trespassers in certain circumstances). Public liability claims form approximately 21% of all personal injury claims.
Employer liability claims: Workplace injuries — falls from height, manual handling injuries, chemical exposures, equipment accidents. Employers have a duty of care under the Health and Safety at Work Act 1974. Workers injured at work have three years from the date of the accident (or the date they became aware of an injury) to bring a personal injury claim. Employer liability claims form approximately 16% of all personal injury claims.
The Whiplash Reform Programme
The Civil Liability Act 2018 and subsequent Whiplash Injury Regulations fundamentally changed how low-value RTA personal injury claims are processed and compensated in England and Wales. Key changes include:
- Fixed tariff of damages for whiplash injuries lasting up to two years, set in law — replacing judicial assessment of each claim individually
- Ban on settling whiplash claims without medical evidence — preventing "cash for whiplash" settlement practices
- OIC portal for claims up to £5,000 — allowing unrepresented claimants to bring their own claims
- Small Claims Track limit raised from £1,000 to £5,000 for RTA personal injury — meaning legal costs are not recoverable in most minor injury cases
- Tariff uplift of approximately 15% from May 2025 following the statutory review
The reforms have significantly reduced the volume of motor injury claims and reduced payouts for minor injuries.
